In consideration of [Your Company Name], a Florida company ("Company"), performing a site visit, water quality assessment, consultation, or related pre-installation services at the above property, the undersigned Customer freely and voluntarily agrees as follows:
- Acknowledgment and Assumption of Risks: Customer acknowledges and understands that site visits and assessments involve inherent risks, including but not limited to slips, trips, falls, exposure to existing plumbing or water conditions, temporary disruption of water service, minor property damage, personal injury, or other hazards associated with entering and inspecting residential premises. Customer voluntarily assumes all such risks, known or unknown, including those arising from the Company's negligence.
- Clear Release of Liability: Customer hereby clearly and unequivocally releases, waives, discharges, and agrees not to sue the Company, its owners, officers, employees, agents, or subcontractors from any and all claims, demands, actions, damages, losses, or liability (including attorney's fees) for personal injury, property damage, or other harm arising out of or related to the site visit or assessment, including claims based on the Company's ordinary negligence.
- Indemnification: Customer agrees to indemnify and hold harmless the Company from any claims by third parties (e.g., family members or visitors) arising from the site visit.
- No Guarantees: Customer understands that the site visit provides no guarantees regarding future water quality, system suitability, or performance.
- Limitations: This release does not apply to claims arising from the Company's gross negligence, recklessness, or intentional misconduct.
- Governing Law: This Agreement shall be governed by and construed under the laws of the State of Florida. Venue for any dispute shall be in [County where your company is based], Florida.
